Those that say opposite colored bishops is a draw.

It's a draw unless one side makes a mistake. In this case, Black obviously made a huge mistake by allowing mate in 1 on his 41st move.

Notice the only possibilities for draw from insufficient material are king vs king, king+bishop vs king, and king+knight vs king. In these circumstances, no matter how badly the lone king moves, it can never run into checkmate. In any other circumstance (king+knight vs king+pawn, king+bishop vs king+bishop, king+2 knights vs king, etc.) there are possible checkmates if one side blunders, as you pointed out.

Even though draw from insufficient material won't be claimed automatically, you could probably offer a draw and any reasonable opponent would accept it.
