Draw proposal accepted late

I made a proposal of draw to my partner which he refused.3 moves later I obtained a better, winning position. At this new moment,my partner accepted the draw and the game ended in a draw! It seems unfair and not correct, having in mind that a proposal have to be accepted at once, not later! Please analyse and come to a reasonable solution to be implemented for the server for future games
But if you were in best position, why you not cancelled the proposal?

That is similar to not pay attention to the clocks at less in my opinion.
Under article 9.1.b of the FIDE laws of chess "In both cases the offer cannot be withdrawn and remains valid until the opponent accepts it, rejects it orally, rejects it by touching a piece with the intention of moving or capturing it, or the game is concluded in some other way". So, the offer clearly lapses once the offeree makes a move - it does not remain on the table indefinitely (that would be crazy - no-one would offer a draw, for fear it would be relied upon in a totally different position). This is in OTB, but, unless there is anything to the contrary in LICHESS or otherwise, it should apply.
It would indeed be more efficient to make moving a piece an automatic draw refusal, but don't just disregard your personal responsibility to cancel the offer manually under the current system. In other words, that was all your fault; suck it up and play on.
Ok, from that point of view, ComTaxman, you convince me. Thanks for the explication.
You will not find another important chess site when, once you move after receiving a draw offer, still you keep the possibility to accept it later.
I agree that moving should cancel draw offer. This is especially important in quick games.

ChessCaptcha! :D
You're supposed to manually click cancel offer...same as takeback offer.
